Terms & Conditions

1. Definitions:

• “Agreement” refers to these Terms and Conditions and the Privacy Policy.
• “Individual Subscriber” is a person who subscribes to English Wagon.
• “Intellectual Property Rights” or “IPR” means all intellectual property rights including patents, rights to inventions, copyright and related rights now or in the future in any part of the world.
• “Privacy Policy” is our policy displayed on our Website at www.englishwagon.com detailing how we handle your personal data.
• “Student” is a reference to the person who has signed up for an Individual Subscriber account or (in the case of that person being under 18 years old) has been granted access to English Wagon by the Individual Subscriber in accordance with these Terms and Conditions.
• “English Wagon” is our online learning system available on our Website consisting of the English Wagon Courses.
• “English Wagon Course(s)” or “Course(s)” are our online learning programs.
• “you”, “your” and “yours” refer to the Individual Subscriber and/or the Student.
• “we”, “us” and “our” refer to Techbooq Limited a company incorporated in England and Wales with company number 11366959, Bank Gallery, 13 High Street, Kenilworth, Warwickshire, United Kingdom, CV8 1LY.
• “Website” is www.englishwagon.com.

2. Subscription Process:

• Individual Subscribers select English Wagon Courses, provide their name and email, and complete a registration profile to create an Individual Subscriber account.
• Account sharing is not allowed.

For Students 18 Years or Older:

• • You confirm you are over 18 and can legally agree to this contract.
  • The contract for English Wagon is between you and us.
  • You will not let others access your English Wagon Courses.

For Students Under 18:

• • We do not provide accounts to those under 18. We may close your account if we believe you are under 18.
  • Parents or guardians can subscribe for those under 18. By subscribing, you confirm you are over 18 and are the parent or guardian of the Student.
  • Only one Student per subscription is allowed to access the English Wagon Course.

3. Registration:

• To register, you will need to provide your full name, contact details, and a valid email.

4. Changing your Mind:

• If you change your mind you can cancel a subscription within 7 days of starting your subscription via your account and get a full refund. But if you or a Student downloads or uses digital content from our Website, you are waiving your right to cancel within the 7-day cooling-off period. After a download starts or finishes, no refunds are given, and the transaction is final.
• After the 7 day right to cancel has expired or been waived as described above, you can end your subscription in the manner described in clause 11 below but you will not be eligible for a refund for amounts already paid.

5. Usage:

• English Wagon is for Student use only.

6. Account Security:

• You will get a registration profile when using the Website. Keep these details secure and do not share them with anyone.

7. Course Availability:

• We can change or discontinue any English Wagon Course available on the Website.

8. Prices and Payment:

• All prices on the Website are correct at publication but may change. Prices include VAT. The cost of English Wagon depends on the English Wagon Courses you subscribe to.
• The total price for English Wagon is displayed when you order. You can apply promotional codes before payment.
• We may offer discounts for packages of two or more English Wagon Courses. The discount applies if they are purchased together.
• You can pay for your English Wagon Course(s) in a single payment upfront or (except for the “Grammar Locker” course) by monthly direct debit. If you pay in a single payment upfront, you will receive a discount on the price of the English Wagon Course(s) you have chosen. If you pay by direct debit, the monthly amount is deducted on the same day each month until you cancel. Ensure you have enough funds to avoid an administration charge.
• When you sign up, you will provide payment details. The first monthly payment (if you pay monthly rather than upfront) is charged when you sign up, with monthly payments thereafter.
• For secure online shopping, your card details are encrypted. Your card company or bank may do security checks.
• We will take reasonable care to keep your order and payment details secure. We are not liable for any loss if a third party accesses your data on the Website, unless it is due to our negligence.
• If we do not receive a payment on time, we may suspend or cancel the Student’s access to English Wagon.
• All our discounts or special offers are subject to additional terms and conditions. We may change or withdraw these offers at any time.

9. Access and Use

• After signing up for English Wagon, you can set up your user and Student profiles, select English Wagon Courses, and start once the profile is complete and payment is received.
• It is your responsibility to ensure the chosen English Wagon Course suits the Student. Completing an English Wagon Course requires significant effort and regular participation. Some modules may require more effort than others, and progress is not linear.
• Unless cancelled, English Wagon Course access is usually for a specified time. Students are encouraged to complete the English Wagon Course within this time.
• English Wagon Course content may change over time for improvements, clarifications, error corrections, or language updates.
• You should regularly monitor the Student’s engagement and progress.

10. Privacy Policy

• We need some of your personal information to provide English Wagon effectively. For example, an email is needed to open an account. We take data protection seriously and have measures to secure your data.
• Our Privacy Policy explains more about how we handle your data.

11. Ending your Subscription

• You can end your subscription to one or more English Wagon Courses anytime before the next monthly payment is due. Your access to the cancelled English Wagon Courses continues until the end of the month.
• The subscription for the “GrammarLocker” course shall end on the anniversary of your subscription unless you renew it.

12. Licence

• Students are granted a revocable, non-exclusive, non-transferable, worldwide licence to use the English Wagon Courses for the subscription period.

13. Intellectual Property Rights (IPR)

• All IPR in English Wagon, including our Website and App, remain our property or that of the software owners. You must not modify, copy, reproduce, upload, store, post, transmit, distribute, or download from English Wagon or our Website unless expressly invited to do so.

14. Licence Conditions

• Access to our Website and English Wagon is granted on the condition that you do not commercially exploit English Wagon, modify or make derivative works based upon it, embed it as an “iframe” or “frame”, use an internet bot, reverse engineer, send or store harmful computer code, interfere with or disrupt the service, attempt to gain unauthorised access, or impose a large load on our system.
• You cannot use English Wagon to develop your own software or copy any part of English Wagon to develop any software or other product or technology, unless that use or copying is permitted by law.

15. Our Right to End or Suspend Your Account

• We can cancel or suspend your account if we reasonably suspect you have breached these Terms and Conditions.

16. Technical Support

• Email us for operational queries about English Wagon or access to Courses. We aim to respond within 5 working days.
• Access English Wagon from any internet-enabled desktop PC, mobile device, or tablet. High-speed broadband is recommended.
• Ensure the Student uses the latest version of their internet browser and/or English Wagon App for correct format and functionality.

17. Complaints

• We take complaints seriously and aim to respond within 5 working days. Email us your complaints to enquiries@englishwagon.com.

18. Disclaimer and Liability Limits

• We strive to ensure the accuracy of information on the Website and English Wagon. We will correct any errors or omissions as soon as identified. However, we cannot guarantee that English Wagon or the Website will be error-free, timely, virus-free, or fully functional.
• WE DISCLAIM ALL LIABILITY FOR ENGLISH WAGON AND THE ENGLISH WAGON COURSES TO THE FULLEST EXTENT PERMISSIBLE UNDER LAW. IF WE ARE FOUND LIABLE FOR ANY LOSS OR DAMAGE, SUCH LIABILITY IS LIMITED TO THE AMOUNT YOU HAVE PAID FOR ENGLISH WAGON. THIS DOES NOT AFFECT YOUR STATUTORY RIGHTS AS A CONSUMER.
• English Wagon and the English Wagon Courses are provided “as is”. We do not guarantee their suitability or accuracy. Use is at your own risk.
• We are not liable for any delays, failures, errors, loss of transmitted information, or viruses transmitted via English Wagon or the Website.
• We are not liable for any failure or delay in delivering English Wagon due to circumstances beyond our reasonable control.
• We have taken reasonable steps to prevent internet fraud and secure your data. We are not liable for any breach in our secure computer servers or those of third parties.

19. General Legal Points

• We may subcontract parts of English Wagon and assign or novate our rights under these Terms and Conditions without your consent or notification.
• We may alter the Terms and Conditions at any time. Updates will be published on the Website.
• These Terms and Conditions and the Privacy Policy constitute the entire agreement between you and us. In case of conflict, these Terms and Conditions prevail.
• If any term or condition is deemed invalid, illegal, or unenforceable, it will be deemed deleted and the remainder of the Agreement will continue in force.
• These Terms and Conditions and our Agreement are governed by and interpreted under the laws of England and Wales.
